Although Virginia Code § 8.01-66.1 also applies to uninsured motorist insurance, an insurance company does not act in bad faith by refusing to pay an uninsured motorist claim before the insured obtains a judgment against the tortfeasor. Manu v. GEICO Cas. Co., __ Va. __, 798 S.E.2d 598, 607 (2017).

In re National Lloyds Ins. Co., 532 S.W.3d 794 (Tex. 2017) extended work product privilege to cover billing records where a party is not making a claim for attorney fees. This decision provides greater protection of the insurer's litigation decisions as permitting disclosure would serve as a roadmap of how the insurer plans to litigate not only this particular case but all of its related cases.

UM/UIM carriers should be vigilant to raise a defense quickly. In a 2017 case, a carrier received notice that the insured settled with a tortfeasor on the day before trial. But the carrier did not raise the defense until a post-trial motion. The court held that the carrier waived the defense. Travelers Indem. v. Worthington, 252 So. 3d 645 (Ala. 2017).
