In Webb-Benjamin, Ltd. v. International Rug Group, Ltd., 2018 Pa. Super. Lexis 742 (June 28, 2018), the Pennsylvania Superior Court held that general personal jurisdiction exists over any corporation that is registered to do business in Pennsylvania pursuant to 42 Pa.C.S. §5301. With this decision, the mere registration to do business in the state confers general jurisdiction and dramatically expands the ability of corporations to be sued in plaintiff-friendly jurisdictions in Pennsylvania and thus increases insurers' exposure.

A recent case overrules prior precedent that had permitted defendants to have ex parte communications with a plaintiff’s treating doctor. Harrold-Jones v. Drury, 422 P.3d 568 (2018). This will impact insurance industry by limiting the nature of permissible discovery from a plaintiff’s/claimant’s treating physicians.

Effective 1/1/18, The Local Governance Act, SNB 2017 c 18 replaces the Municipalities Act. This legislation impacts the limitation period involving actions against local governments for damages from failure to maintain sidewalks and other public spaces. Governments must be notified of accidents within 90 days of an event, or Plaintiffs' claims will be barred subject to exceptions.
