The Mlekush case will impact the industry in decision making on offers to settle UIM cases prior to trial. It confirms the insurance exception to the American Rule regarding attorney fees as it applies in UIM cases where the insured obtains a verdict in excess of insurer’s last offer to settle. Mlekush v. Farmers Ins., 389 Mont. 99, 404 P.3d 704 (2017).

The New Jersey Supreme Court has ruled the admissibility  of experts requires gatekeeping by the trial court considering factors Daubert. In re: Accutane Litigation, (A-25-17) (079958).

Under a recent case involving negligence,  plaintiffs will now be relieved of the burden of proof at trial to establish negligence.  Defendants at trial must establish comparative liability against plaintiff and litigate damages.  Rodriguez v. City of New York, 31 N.Y.3d 312, __ N.E.3d. 312 (2018).

The Court of Appeals of Maryland has stated that the Court will not expand exclusions to insurance policies beyond those explicitly enumerated by the General Assembly. Md. Ins. Admin. v. State Farm Auto. Ins. Co., 451 Md. 323, 345-6 (2017).
